The research examines the role of administrative procedures in the ecological transition and in the development of circular economy models, starting from the recognition of a structural tension between decision-making acceleration and the protection of environmental interests. Recent European and national regulatory developments, strengthened by the 2022 constitutional reform and by the objectives of the Green Deal and the PNRR, assign public administrations a function that is no longer merely regulatory or repressive, but enabling and shaping sustainable economic processes. However, this function operates within environmental procedures characterised by high complexity, regulatory fragmentation and the involvement of multiple public authorities, which often renders the simplification formally proclaimed by the legislator ineffective. The thesis demonstrates that the traditional approach to administrative simplification – mainly oriented towards reducing guarantees and compressing investigative phases – proves inadequate in the presence of sensitive interests. In environmental matters, complexity is not an eliminable anomaly but a necessary component of public decision-making. Consequently, true simplification does not coincide with the removal of controls, but rather with procedural rationalisation and coordination of competences. On this basis, the research identifies Regulation (EU) 2023/1542 on batteries as an innovative regulatory model of “simplification through uniformity”. As a directly applicable act, it overcomes the fragmentation of national regulations and introduces mechanisms of standardisation, traceability and digitalisation throughout the entire life cycle of the product. In particular, the digital battery passport represents a tool capable of transforming the administrative procedure from an authorisation sequence into a continuous information system, reducing administrative burdens without weakening environmental safeguards. The study concludes with an operational de iure condendo proposal for the implementation of the Regulation within the Italian legal system, based on the mapping of administrative requirements, inter-administrative coordination and digital integration of controls. This leads to a different understanding of simplification: not deregulation, but an improvement in decision-making quality through the reduction of duplications and the use of shared digital tools. The research therefore shows that the administrative procedure can become a governance tool for the ecological transition, capable of combining efficiency, environmental protection and effectiveness of public policies, provided it is redesigned from a systemic and technological perspective.
La ricerca analizza il ruolo del procedimento amministrativo nella transizione ecologica e nell’affermazione dei modelli di economia circolare, muovendo dalla constatazione di una tensione strutturale tra accelerazione decisionale e tutela degli interessi ambientali. L’evoluzione normativa europea e nazionale, rafforzata dalla riforma costituzionale del 2022 e dagli obiettivi del Green Deal e del PNRR, assegna infatti alla p.A. una funzione non più soltanto repressiva, ma abilitante e conformativa dei processi economici sostenibili. Tuttavia, tale funzione si confronta con procedimenti ambientali caratterizzati da elevata complessità, frammentazione normativa e una pluralità di soggetti pubblici coinvolti, che rendono spesso ineffettiva la semplificazione formalmente proclamata dal legislatore. La tesi dimostra come l’approccio tradizionale alla semplificazione amministrativa, prevalentemente orientato alla riduzione delle garanzie e alla compressione delle fasi istruttorie, risulti inadeguato in presenza di interessi sensibili. In ambito ambientale, infatti, la complessità non costituisce un’anomalia eliminabile, ma una componente necessaria della decisione pubblica. Ne deriva che la vera semplificazione non coincide con la sottrazione di controlli, bensì con la razionalizzazione del procedimento e con il coordinamento delle competenze. Su tali basi, la ricerca individua nel Regolamento (UE) 2023/1542 relativo alle batterie un modello normativo innovativo di “semplificazione per uniformazione”. Trattandosi di atto direttamente applicabile, esso supera la frammentazione delle discipline nazionali e introduce strumenti di standardizzazione, tracciabilità e digitalizzazione lungo l’intero ciclo di vita del prodotto. In particolare, il passaporto digitale delle batterie rappresenta un meccanismo idoneo a trasformare il procedimento amministrativo da sequenza autorizzatoria a sistema informativo continuo, capace di ridurre gli oneri burocratici senza comprimere le garanzie ambientali. Il lavoro si conclude con una proposta operativa de iure condendo per l’attuazione del Regolamento nell’ordinamento italiano, fondata sulla mappatura degli adempimenti, sul coordinamento inter-amministrativo e sull’integrazione digitale dei controlli. Ne emerge una diversa concezione della semplificazione: non deregolazione, ma aumento della qualità decisionale attraverso la riduzione delle duplicazioni e l’uso di strumenti informatici condivisi. La ricerca dimostra quindi che il procedimento amministrativo può costituire una leva di governo della transizione ecologica, in grado di coniugare efficienza, tutela ambientale ed effettività delle politiche pubbliche, purché ripensato in chiave sistemica e tecnologica.
