In the regulations for the carrying out of the act n. 109/94 (and following emendations) the legislator, with the intention of restricting a government official's discretionary powers in the choice of a contractor for a tender, a competition, or a grant for public works, according to the selection criteria of the most economically competitive offer, introduced some enforcing rules. The simplest of these is the associative-compesatory method. However, this method, as formulated in the regolations, presents some irregularities and errors, which can result in anomalies when selecting the winner. This work points out the necessary corrections to the selection procedure.
